DNA clears man of rape charges after nearly five years in prison

NEWSCHANNEL 5: "The Texas Court of Criminal Appeals agreed with a lower court to overturn the sexual assault conviction of a man who served almost five years of a 25-year sentence before DNA tests exonerated him.

Josiah Sutton, 23, was released in March 2003 after DNA tests cleared him. His case was among hundreds in which DNA samples were retested after a state audit found problems in the Houston Police Department's crime lab."
